These Terms of Use ("Terms") govern your access to and use of 101bt.com (the "Site"), a search engine that indexes publicly available BitTorrent metadata from the DHT network. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

These Terms are designed to limit our liability to the maximum extent permitted by law. We strongly recommend that you read them carefully.

1. Acceptance of Terms

By using the Site, you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Site on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.

2. Description of the Site

The Site provides a search functionality for metadata related to BitTorrent distributions available in the public DHT network. We do not host, store, upload, download, or distribute any files, torrents, or content. All search results are derived from publicly available data in the BitTorrent ecosystem, which is decentralized and user-generated. We have no control over the content, accuracy, legality, or availability of any indexed metadata or associated files.

3. User Conduct and Prohibited Activities

You agree to use the Site only for lawful purposes and in accordance with these Terms. You are solely responsible for your use of the Site and any actions you take based on information obtained from it.

Prohibited activities include, but are not limited to:

Using the Site to violate any local, state, national, or international laws, including copyright, trademark, or other intellectual property laws.
Attempting to access, interfere with, or disrupt the Site's operations, servers, or networks.
Using automated tools (e.g., bots, scrapers) to access the Site without our express written permission.
Uploading, posting, or transmitting any harmful content, such as viruses, malware, or spam.
Engaging in any activity that could harm, disable, overburden, or impair any part of the Site.
Impersonating any person or entity or misrepresenting your affiliation with any person or entity.

We reserve the right to monitor use of the Site and to terminate or restrict access at any time, without notice, for any reason, including suspected violations of these Terms.

4. Intellectual Property

Any metadata or search results displayed on the Site are derived from third-party sources. We make no claims of ownership over such content and provide it solely for informational purposes.

5. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR AVAILABILITY.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS REGARDING THE LEGALITY, QUALITY, SAFETY, OR SUITABILITY OF ANY CONTENT INDEXED ON THE SITE. YOU USE THE SITE AT YOUR OWN RISK.

WE EXPRESSLY DISCLAIM ANY RESPONSIBILITY FOR THE ACTIONS OF USERS OR THIRD PARTIES, INCLUDING ANY VIOLATIONS OF LAW ARISING FROM THE USE OF SEARCH RESULTS OR ASSOCIATED FILES.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100), OR THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS, WHICHEVER IS LESS. IF NO SUCH PAYMENT WAS MADE, OUR LIABILITY SHALL BE ZERO.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

7. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including copyright, trademark, or privacy rights; or (d) any claim that your actions caused damage to a third party.

This indemnification obligation will survive the termination of these Terms and your use of the Site.

8. Third-Party Links and Content

The Site may contain links to third-party websites or resources. We are not responsible for the availability, accuracy, or content of such external sites or resources. Your use of third-party links is at your own risk, and we disclaim all liability related thereto.

9. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will cease immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and you consent to the personal jurisdiction and venue therein.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on the Site with the "Last Updated" date revised. Your continued use of the Site after such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

12. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Site. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be considered a waiver of those rights.
